Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Al Higgins Consulting Services Ltd., operating as On Demand Training (“On Demand Training”, “we”, “us”). They apply when you visit ondemandtraining.ca (the “Site”) or buy or use our courses, practice exams, quizzes or other learning tools (the “Products”). By creating an account or buying a Product, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Who we are

On Demand Training provides online exam preparation for non-destructive testing (NDT) and related subjects, in English and French.

2. We are not an exam or certification body

Our practice exams are study tools. They are designed to resemble the format, time limits and pass marks of official exams, but they are not official exams and do not contain official exam questions. We are not part of, endorsed by or affiliated with Natural Resources Canada (NRCan), CINDE, the Canadian General Standards Board (CGSB) or any other certification or exam body, unless we clearly say so. Using our Products does not guarantee that you will pass any exam or obtain any certification.

3. Your account

  • You must give accurate information when you register and keep it up to date.
  • Your account is for one person only. Do not share your login or let anyone else use your access.
  • Keep your password private. Tell us right away at info@ondemandtraining.ca if you think someone else has used your account.
  • You must be at least 16 to create an account. If you are under the age of majority in your province, a parent or guardian must agree to these Terms for you.

4. Buying Products

  • Prices. Prices are shown in Canadian dollars. GST/HST or other applicable sales taxes are added at checkout. Our GST/HST registration number is 87135 8669 RT0001.
  • Payment. Payments are processed by PayPal. We do not see or store your full card or bank details.
  • Language versions. English and French versions are sold separately. A bilingual bundle includes both.
  • Order confirmation. After payment, you will receive an email confirmation and receipt. Please keep it for your records.
  • Price changes. We may change prices at any time. Changes do not affect Products you have already paid for.

5. Access period and extensions

  • Each practice exam purchase gives you access for 60 days from the date of purchase, unless the product page says otherwise.
  • When your access period ends, your access to that Product stops automatically.
  • You can buy an extension: C$9.99 for 30 days or C$14.99 for 60 days, plus tax.
  • Access periods run continuously. They are not paused if you do not log in.

6. Refunds

Because our Products are digital and available immediately, all sales are final once you have opened or started any part of the purchased content. If you have not yet accessed the content, you may ask for a full refund within 14 days of purchase by writing to info@ondemandtraining.ca.

We will also fix the problem or refund you if a Product does not work as described and we cannot correct it within a reasonable time.

Nothing in this section limits any right you have under the consumer protection laws of your province, including Quebec’s Consumer Protection Act.

7. How you may use our content

All Site content, including questions, answers, explanations, images, diagrams, translations and course material, belongs to us or our licensors and is protected by copyright.

We give you a personal, non-transferable right to use the Products for your own study during your access period. You may not:

  • copy, screenshot, record, download, print or share questions, answers or explanations, except for brief personal notes;
  • post our content online, sell it, or give it to anyone else, including other students, schools or training providers;
  • use bots, scrapers or other automated tools to access or collect content;
  • use our content to train, test or build any artificial intelligence or machine-learning system;
  • try to get around access limits, timers or security features.

If you break these rules, we may suspend or close your account without a refund, in addition to any other remedies the law allows.

8. Acceptable use

When using the Site, you agree not to break any law, harm the Site or its users, upload viruses or harmful code, impersonate anyone, or send spam.

9. Availability and changes to Products

We work to keep the Site available, but we cannot promise it will always be error-free or uninterrupted. We may need to take it offline for maintenance. We may update, correct or improve Products at any time, for example to fix errors or reflect changes in exam formats. If we remove a Product you paid for before your access period ends, we will offer you a comparable Product or a partial refund for the unused time.

10. Accuracy of content

We take care to make our content accurate, but errors can happen and codes, standards and exam requirements change. Always check official sources, such as current codes, standards and your certification body’s requirements. If you think a question or answer is wrong, please tell us so we can review it.

11. Limitation of liability

To the extent the law allows:

  • the Site and Products are provided “as is”;
  • we are not responsible for indirect losses, such as lost income, lost job opportunities or exam fees;
  • our total responsibility to you for any claim about a Product is limited to the amount you paid for that Product.

These limits do not apply where the law does not allow them, including under Quebec law and for losses caused by our gross negligence or intentional misconduct.

12. Ending your account

You may close your account at any time by emailing info@ondemandtraining.ca. Closing your account ends your access and does not give you a refund. We may suspend or close your account if you break these Terms. Sections 7, 11 and 14 continue to apply after your account ends.

13. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new “Last updated” date. If a change is important, we will also email you. Changes do not affect Products you bought before the change.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live in another province, you keep any rights the consumer laws of your province give you, including the right to bring a claim in your local courts.

15. Language

These Terms are available in English and French. Les présentes conditions sont disponibles en français et en anglais. If there is a difference between the two versions, the version you accepted applies.
